Murder process against doctor: Despite many open questions, accused must remain in custody

Regensburg - A doctor accused due to murder must remain in custody - his defense lawyer had submitted an application for prison on Monday.

The chamber has not yet decided on this.While the defender, after the presentation of several reports, had no longer an urgent suspicion of a deliberate homicide against his client, the presiding judge continued to rule out a conviction on Monday.
However, the chamber granted a legal indication that instead of a conviction for murder, a conviction for attempted murder could also be considered in the event of dangerous bodily harm - for example, if it was not undoubtedly proof that the morphine administration was caused by the death.
A conviction due to attempted murder could lead to punishment for punishment, but would still be considerable - insofar as there was no detention at the moment.
Ultimately, however, an acquittal is still possible, as a court spokeswoman explained.
